Every year again...the annual vacation planning begins
The end of the year is approaching and the last vacation days for this year have already been planned. For many employees, this means that vacation planning for 2024 is already starting. Does your company stipulate that all vacation must be planned at the beginning of the year?

As for vacation days for unforeseen situations, the good news for those who don't like to plan long-term is that this is usually not necessary.
The less good news for spontaneous holidaymakers is that employers can require employees to specify their vacation requests in advance. However, this obligation cannot cover the entire annual leave. Employees should be able to keep a certain number of vacation days free for unexpected situations. The exact number depends on the circumstances and operational requirements. However, this obligation should not cover the entire annual leave.
An orientation to the case law on company vacations could be helpful here. According to a landmark decision by the Federal Labor Court (Ref.: 1 ABR 79/79), it is appropriate for three-fifths of the vacation entitlement to be taken for company vacations. From this it can be deduced that at least 60% of annual leave must be applied for at the beginning of the year with regard to annual leave planning.
Exceptions exist, for example, in sectors such as construction, where there are a particularly large number of orders. Here, it may be necessary to plan more than 60 percent of annual leave at the beginning of the year. In companies where early vacation planning is important, it may be decided, with the consent of the works council, to plan the entire annual leave.
