What does residual leave mean?

Remaining vacation designates the Entitlement to vacation days not yet taken, that employees can carry over from one working year to the next.
The aim is to, ensure that employees can actually use the vacation days to which they are legally or contractually entitled.

Background: Legal basis

In Austria, there are legal requirements that Vacation law are regulated:

  • Transfer of remaining vacation: Vacation that has not been taken in the current year can generally be carried forward to the next calendar year become
  • Decay: Remaining vacation often expires after March 31 of the following year, unless it is transferred for operational reasons
  • Employees leaving the company: As a rule, unused vacation must be be paid out
  • Part-time and special arrangements: Remaining vacation is calculated pro rata

How does residual leave work in practice?
