Why is trust-based working time so controversial? In this blog, we will tell you what trust-based working hours really mean, what opportunities and risks they entail and which legal regulations employees and employers must observe.
In 2019, the European Court of Justice (ECJ) ruled that employers must set up a system for recording working hours. This decision was based on various European legal principles and fundamental rights. Although this ruling was controversial in Germany, no active legal regulation has been introduced to date.
However, the Federal Labor Court (BAG) determined in 2022 that there is a general obligation to record working hours. The Federal Office of Labor and Social Affairs' draft bill on recording working hours now provides for the following key new regulations (see Source):
1. the employer will be obliged to record the start, end and duration of employees' daily working hours. The record must be kept on the day the work is performed.
2. working time recording should generally be carried out electronically. However, this may be deviated from by collective agreement or company or service agreement. Transitional regulations will be introduced, particularly for small and medium-sized enterprises.
3. in the case of trust-based working time, the obligation to keep records remains in place, but the employer must ensure that violations of the working time regulations become known. However, the obligation to monitor does not apply, only the obligation to keep records.
4. the employer must provide information about the recorded working time at the request of the employee and provide a copy of the records.
